서비스 이용약관
본 약관은 브레인베리(이하 '회사')이 제공하는 기별온 서비스(이하 '서비스')의 이용 조건 및 절차, 회사와 이용자의 권리·의무를 규정합니다.
제1조 (목적)
본 약관은 회사가 제공하는 기별온 서비스의 이용과 관련하여 회사와 이용자 간의 권리, 의무 및 책임사항을 규정함을 목적으로 합니다.
제2조 (정의)
1."서비스"란 폐쇄형 그룹 내 단방향 공지 전달 및 확인 기능을 제공하는 기별온 모바일 애플리케이션을 말합니다.
2."이용자"란 본 약관에 따라 서비스를 이용하는 회원을 말합니다.
3."그룹"이란 공지를 주고받기 위해 구성된 폐쇄형 공간을 말합니다.
4."그룹장"이란 그룹을 생성하고 공지를 작성·관리하는 이용자를 말합니다.
5."멤버"란 초대 코드를 통해 그룹에 참여하여 공지를 수신·확인하는 이용자를 말합니다.
6."기별(공지)"이란 그룹장이 그룹 내에 게시하는 게시물을 말합니다.
제3조 (약관의 효력 및 변경)
1.본 약관은 서비스 화면에 게시하거나 기타 방법으로 공지함으로써 효력이 발생합니다.
2.회사는 관련 법령을 위반하지 않는 범위에서 약관을 변경할 수 있으며, 변경 시 시행일 7일 전(이용자에게 불리한 변경은 30일 전)부터 공지합니다.
3.이용자가 변경된 약관에 동의하지 않을 경우 서비스 이용을 중단하고 탈퇴할 수 있습니다.
제4조 (서비스의 제공)
회사는 다음의 서비스를 제공합니다.
- 그룹 생성 및 초대 코드 기반 참여
- 공지 작성·발송 및 푸시 알림
- 공지 확인 현황 및 미확인자 재알림(넛지)
서비스는 연중무휴 24시간 제공을 원칙으로 하나, 시스템 점검·장애 등의 경우 일시 중단될 수 있습니다.
제5조 (회원가입 및 계정)
1.이용자는 카카오, Apple 또는 구글 계정을 통한 소셜 로그인으로 회원가입을 합니다.
2.이용자는 본인의 계정을 직접 관리해야 하며, 계정 도용 등으로 발생한 책임은 이용자에게 있습니다.
3.이용자는 언제든지 탈퇴할 수 있으며, 탈퇴 시 관련 정보는 개인정보처리방침에 따라 처리됩니다.
제6조 (그룹장과 멤버의 권한)
1.그룹장은 공지를 작성·삭제하고, 멤버를 초대하며, 그룹을 관리할 수 있습니다.
2.멤버는 공지를 수신·확인할 수 있으며, 공지 작성 권한은 없습니다.
3.본 서비스는 댓글·채팅 등 양방향 소통 기능을 제공하지 않습니다.
4.멤버는 언제든지 그룹에서 탈퇴할 수 있습니다.
제7조 (이용자의 의무)
이용자는 다음 행위를 하여서는 안 됩니다.
- 타인의 개인정보를 무단으로 수집·이용·공개하는 행위
- 허위·과장·불법 정보를 공지로 게시하는 행위
- 욕설·비방·차별·혐오 표현을 게시하는 행위
- 음란물, 스팸, 광고성 정보를 유포하는 행위
- 서비스 운영을 방해하거나 시스템에 무단 접근하는 행위
- 관련 법령 또는 공공질서·미풍양속에 반하는 행위
제8조 (게시물의 관리와 책임)
1.공지(게시물)의 내용에 대한 책임은 이를 작성한 그룹장에게 있습니다.
2.회사는 게시물이 본 약관 또는 법령을 위반하는 경우 사전 통지 없이 삭제하거나 이용을 제한할 수 있습니다.
3.이용자가 작성한 게시물의 저작권은 작성자에게 귀속됩니다.
제9조 (서비스 이용 제한)
회사는 이용자가 본 약관을 위반하거나 서비스의 정상적 운영을 방해한 경우 사전 경고, 일시 정지, 영구 이용 정지 등의 조치를 취할 수 있습니다.
제10조 (면책조항)
1.회사는 천재지변, 통신사·플랫폼 장애 등 불가항력으로 인한 서비스 중단에 대해 책임을 지지 않습니다.
2.회사는 이용자 간 또는 그룹 내에서 발생한 분쟁에 개입하지 않으며, 그에 대한 책임을 지지 않습니다.
3.회사는 이용자가 게시한 공지의 정확성·신뢰성에 대해 보증하지 않습니다.
4.푸시 알림은 통신 환경·기기 설정에 따라 지연되거나 전달되지 않을 수 있으며, 회사는 이에 대한 책임을 지지 않습니다.
제11조 (분쟁 해결 및 준거법)
1.본 약관은 대한민국 법령에 따라 해석되고 적용됩니다.
2.서비스 이용과 관련하여 분쟁이 발생한 경우, 관할 법원은 서울중앙지방법원으로 합니다.
Terms of Service
These Terms govern the conditions and procedures for using the Kibyeolon service ("Service") provided by Brainberry ("Company"), as well as the rights and obligations of the Company and users.
Article 1 (Purpose)
These Terms aim to define the rights, obligations, and responsibilities between the Company and users in relation to the use of the Kibyeolon service provided by the Company.
Article 2 (Definitions)
1."Service" refers to the Kibyeolon mobile application, which provides one-way notice delivery and confirmation features within closed groups.
2."User" refers to a member who uses the Service under these Terms.
3."Group" refers to a closed space formed to exchange notices.
4."Group Leader" refers to a user who creates a group and writes and manages notices.
5."Member" refers to a user who joins a group via an invite code and receives and confirms notices.
6."Notice" refers to a post published by the Group Leader within the group.
Article 3 (Effect and Amendment of Terms)
1.These Terms take effect by being posted on the Service screen or announced by other means.
2.The Company may amend these Terms within the scope that does not violate applicable laws, and will announce any amendment at least 7 days before its effective date (30 days in advance for changes unfavorable to users).
3.If a user does not agree to the amended Terms, the user may discontinue use of the Service and withdraw.
Article 4 (Provision of Service)
The Company provides the following services.
- Group creation and invite-code-based joining
- Notice creation/delivery and push notifications
- Notice confirmation status and reminders to unconfirmed members (nudges)
The Service is provided 24 hours a day, year-round, in principle, but may be temporarily suspended due to system maintenance or failures.
Article 5 (Registration and Account)
1.Users register for membership via social login using a Kakao, Apple, or Google account.
2.Users must manage their own accounts, and the user is responsible for any consequences arising from account misuse.
3.Users may withdraw at any time, and related information will be handled in accordance with the Privacy Policy upon withdrawal.
Article 6 (Rights of Group Leaders and Members)
1.A Group Leader may create and delete notices, invite members, and manage the group.
2.A Member may receive and confirm notices but does not have notice-writing privileges.
3.The Service does not provide two-way communication features such as comments or chat.
4.Members may withdraw from a group at any time.
Article 7 (User Obligations)
Users must not engage in the following conduct.
- Collecting, using, or disclosing others' personal data without authorization
- Posting false, exaggerated, or unlawful information as notices
- Posting profanity, defamation, discrimination, or hate speech
- Distributing obscene material, spam, or advertising content
- Interfering with service operation or gaining unauthorized system access
- Acting against applicable laws or public order and morals
Article 8 (Management and Responsibility for Posts)
1.Responsibility for the content of a notice (post) lies with the Group Leader who created it.
2.The Company may delete a post or restrict use without prior notice if it violates these Terms or applicable laws.
3.Copyright of posts created by users belongs to the author.
Article 9 (Restriction of Service Use)
The Company may take measures such as prior warning, temporary suspension, or permanent suspension of use if a user violates these Terms or disrupts the normal operation of the Service.
Article 10 (Disclaimer)
1.The Company is not liable for service interruptions caused by force majeure such as natural disasters or carrier/platform failures.
2.The Company does not intervene in disputes arising between users or within a group and bears no responsibility for them.
3.The Company does not guarantee the accuracy or reliability of notices posted by users.
4.Push notifications may be delayed or undelivered depending on network conditions and device settings, and the Company bears no responsibility for this.
Article 11 (Dispute Resolution and Governing Law)
1.These Terms are interpreted and applied in accordance with the laws of the Republic of Korea.
2.In the event of a dispute related to the use of the Service, the competent court shall be the Seoul Central District Court.
3.In case of any discrepancy between the Korean and English versions of these Terms, the Korean version shall prevail.
